CONDITIONS OF HIRE
The Mill House & Mill Stream Studio
THE MILL HOUSE RESPONSIBILITIES
1. The space will be provided in a clean, safe and well maintained condition.
2. TMHH will have insurance cover but users are liable for the repair of damage. Instructors must have their own cover
3. TMHH (Ground floor space) has facilities for disabled persons.
HIRERS RESPONSIBILITIES
1. BOOKING
1.1. The Mill House may require the hirer at any time to supply a detailed written description of all activities to be conducted on the premises during the period of hire.
1.2. The booking will not be considered effective by The Mill House until the Conditions of Hire form has been signed
2. CHARGES AND DEPOSITS
2.1. Events for 30 or more people: We ask for a deposit of £200 at the time of booking. This will be refunded after the event if all rubbish has been removed from the premises and the space is left clean and tidy and in a condition suitable for re-hire. If necessary we will deduct an £80 cleaning charge.
2.2. The charges payable by the hirer shall be those set by The Mill House and will be those in force at the time of the hirer's use of premises.
2.3. The hirer shall pay The Mill House the required booking fee, as The Mill House specifies.
3. CANCELLATION
3.1. Where a cancellation is made 21 days or more before the booking a full refund will be given, 20-14 days before the booking a 50% refund will be given, 13-7 days before booking a 25% refund will be given.
3.2. Where notice of cancellation is given less than 7 days before the time for which the premises are booked, any fee paid by the hirer is non-refundable.
3.3 When cancelling a weekly class, where possible please give TMH 21 days notice. Notice less than 21 days will be as per the cancellation policy above. If you know of a date you can’t do (E.g. for a holiday) and give TMH 21 days or more notice, there will be no charge. Notice less than 21 days will be as per the cancellation policy above.
4. COVID-19
4.1. The Hirer acknowledges that COVID-19 may require The Mill House to take one or more of the following measures for the safety of its staff and the hirers entering the space:
(i) Impose maximum capacity and social distancing rules (when instructed by the Government)
(ii) Limit use of crockery and cutlery in the kitchen area.
(iii) Wear a face covering when entering and in the venue where applicable
(iv) Limit any planned entertainment for the Hirer’s event.
(v) Designate alternative entrance and exit routes when applicable.
4.2. The Mill House has a Covid risk assessment (View here). It is advised the hirer carries out their own risk assessment before using the venue.
4.3. If you can provide evidence that you need to transfer your booking due to a Covid-19 related matter we will allow one transfer of your booking to a revised date within a year of the original booking. You will be able to select a date of the same value. If you do not wish to transfer the booking we will revert to our standard cancellation policy (3.1).
4.4. In the event of a Government lock down due to Covid-19, where we’re told to close the venue, you would receive a full refund.
5. INSURANCE
5.1. The hirer shall indemnify and keep indemnified The Mill House against all losses, expenses, liabilities, claims and damages incurred as a result of or arising out of the hiring of the premises whether caused by any act or omission of the hirer, its servants, agents, or invitees.
5.2. The hirer will obtain and keep current public liability insurance cover.
6. DAMAGE TO PREMISES AND EQUIPMENT
6.1. The hirer shall be responsible for the maintenance of good order in and around the premises during the period for which the premises are hired.
6.2. The hirer shall comply with any instruction by The Mill House to the maintenance of good order and compliance with these conditions in and around the premises.
6.3. The hirer shall be responsible for leaving the premises clean and tidy at the end of the hiring. The Mill House may carry out at the expense of the hirer such cleaning or other work as may be required to restore the premises to a satisfactory condition.
6.4. Excepting fair wear and tear, the hirer shall be liable to The Mill House for any damage to premises, or any fittings, equipment, furniture, carpets or other property therein, which occurs during the period of the hiring.
6.5. The Hirer shall not affix adhesive tape to the floor of the warehouse. If the floor seal is damaged by the use of tape the Hirer will be charged for the floor to be resealed.
7. ALCOHOL
7.1. The Mill House is not a licensed premises and no alcohol can be sold thereon without a licence from the local authority. Should the Hirer wish to bring drinks onto the premises for private and moderate consumption, written notice of this is to be provided at the time of booking.
8. CHILD PROTECTION
8.1. In the event that the hiring involves the attendance of children and young persons under the age of 18 at the premises, the Hirer confirms that there will be in place an appropriate Child Protection Procedure. The Hirer agrees to ensure that all adults present on the premises are aware of this Procedure and abide by it. The Hirer confirms that, when necessary under the terms of the Child Protection Procedure, appropriate Criminal Records Bureau checks will be carried out in respect of persons involved with children and young people on the premises during the course of the hiring.
9. PARKING
9.1. The hire of the premises does include the use of parking facilities on a first come first served basis. The Mill House reserves the right to ask for any cars related to this hiring to be removed or prevented from parking on site due to overlapping activities on site.
9.2. Cars parked at owners risk
9.3 Cars are not allowed to park overnight at The Mill House.
10. SMOKING
10.1. Inside the premises is a No Smoking Zone.
11. MUSIC
11.1 The Hirer undertakes to satisfy any requirements under performing rights for the performing or playing of live or recorded music. Any Hirer who intends to play music or have a live band agrees to inform The Mill House in writing at the time of booking. The Hirer undertakes to ensure that all noise is kept to a level such that neighbours are not unduly disturbed. The Hirer agrees in any event to lower music on the premises at 11.00pm, and terminate music at 11:30pm.
12. PUBLIC SAFETY
12.1. Tea lights in proper holders are permitted. Candles are not permitted.
12.2. Highly flammable substances, explosives, fireworks, chinese lanterns and bouncy castles must not be bought into the space.
12.3. Heating is included in the hire charge. Other heating appliances are not allowed.
12.4. Ensure that fire extinguishers, fire exit plans and emergency signs are not obscured.
12.5. All means of exit (especially fire exits) must be kept free from obstruction and immediately available for emergency evacuation. 12.6. In the case of a fire, shout 'FIRE FIRE FIRE'. Evacuate through the nearest fire exit. Ensure children and disabled persons are given all necessary assistance. Check toilets. Exit the site through the green gates and assemble outside the scout hut on Marshgate Drive. Do not attempt to fight the fire. Call 999 immediately.
13. EMERGENCIES
13.1. Report any accidents to The Mill House. A first aid kit and accident report book are provided in the kitchen area.
13.2. In anticipation of an emergency it is the Hirer’s responsibility to ensure that he knows the location of First Aid Kit, the nearest hospital and the like.
14. EXCLUSIONS
14.1. The Hirer shall not use the premises for any purposes other than that described in the Hiring Agreement and shall not sub-hire or use the premises or allow the premises to be used for any unlawful purpose or in any unlawful way, nor do anything to bring on to the premises anything which may endanger the premises or any insurance policies connected with the premises.
15. REGULAR BOOKINGS
15.1. Even if the Hirer has a regular booking for the hire of the premises The Mill House reserves the right to renew, vary or cancel any such regular arrangements. This right will not be unreasonably enforced.
16. ACCESS
16.1. The Hirer shall allow any duly authorised person of The Mill House access to the space at all times during the hire.
17. AFTER THE EVENT
17.1. Take away from the premises all equipment, possessions, waste, recycling, empty bottles etc
17.2. Return the space to how you found it. If it's not left in a clean and tidy condition, you'll incur a £50 cleaning charge.
17.3. Close and lock all external doors. Turn off lights.
18. FORCE MAJEURE
The Mill House shall not be liable for any cancellation in bookings arising from or attributable to acts, events, omissions or accidents beyond its reasonable control (“Force Majeure Event”), including but not limited to any of the following:
18.1 Acts of God, flood, earthquake, windstorm or other natural disaster or adverse weather conditions;
18.2 any damage or other emergency relating to the Venue, or collapse of building structures or failure of machinery;
18.3 closure of roads or cancellation of any air travel relevant to the booking;
18.4 interruption or failure of utility service, including but not limited to electric power, gas or water;
18.5 fire, explosion or accident;
18.6 epidemic or pandemic;
18.7 any law or government order, rule, regulation or direction, or any action taken by a government or public authority, including but not limited to imposing an embargo, export or import restriction, quota or other restriction or prohibition, or failing to grant a necessary licence or consent;
17.8 any labour dispute, including but not limited to strikes, industrial action or lockouts
19. APPLICATION OF THE CONDITIONS OF HIRE
19.1. The Mill House reserves the right to amend or delete any of the conditions of hire as outlined above or to add extra conditions provided that the hirer is notified prior to confirmation of the booking of any changes made to the conditions. The applications of the various conditions may therefore vary from hirer to hirer as The Mill House in its sole opinion considers necessary.
